Daily Halacha - Laws of Bein HaMetzarim, 12 Tammuz 5777

Practical Jewish law guidelines during the Three Weeks period - essential teachings from the rulings of Rabbi Ovadia Yosef

AA

If someone goes to sleep shortly after nightfall on the eve of the 17th of Tammuz, are they permitted to eat when they wake up?

One who sleeps a fixed sleep on their bed, even resting on their elbows, on the night of a fast day, and wakes up in the middle of the night, is forbidden to eat or drink, even before dawn.

However, if they made a condition before going to sleep that they intend to wake up before dawn and eat, they are permitted to eat until dawn. Therefore, it is advisable for someone in the congregation to remind the public at nightfall to make this condition, so that even if they sleep a little, they will still be permitted to eat [Yalkut Yosef Siman 550].
