Sentence for Man Who Hospitalized Wife Twice: 5-Month Suspended Sentence
A resident of the territories was convicted in two cases of assault causing actual bodily harm to his former wife.

A 5-month suspended sentence was handed down by the Jerusalem Magistrate’s Court to a resident of the territories convicted of two instances of assault and harm against his then-wife, as reported in Attorney Lilach Daniel’s article on the "Takdin" website.
The defendant admitted to two offenses. In the first case, he beat his wife until she had to be hospitalized after losing consciousness, vomiting, abdominal pain, and additional injuries. In the second case, he dragged her around the house, threw her to the floor, and beat her until she blacked out, all in front of their young children. After this incident, the woman was also hospitalized suffering from injuries.
The defendant received a sentence of 5 months suspended imprisonment, a fine of 7,000 shekels, and a commitment of 2,000 shekels not to commit further violent offenses. The sentence was given by the President of the Jerusalem Magistrate's Court, Judge Avital Chen.
According to the court president, the reason for the lenient punishment, which he stated was given "with a heavy heart," is due to the fact that 7 years have passed since the last offense he was convicted of. In addition, the couple divorced about 6 years ago, and according to the woman, they now have a stable relationship while raising their children. The woman even described that the defendant provides her and their children good treatment, assistance, and support. Both have since remarried.
Moreover, since these offenses, the defendant has not been convicted of other violent offenses, and only has one previous conviction for an unrelated illegal matter. No other criminal files have been opened against him except for the case in court. Additionally, it was not possible to impose community service on him since he is a resident of the territories. Therefore, although the severity of the offenses might have warranted actual imprisonment, the court president decided to impose only a suspended sentence, as mentioned.
Nevertheless, the court president highlighted that the actions committed by the defendant directly harm the protected value in the offense of partner assault, namely, the safeguarding of an individual's personal safety and physical well-being. Due to this, each of the charges on which the defendant was convicted could have led to a sentence of up to 10 months in prison, were it not for the mitigating circumstances.
